The Occupational Therapy Act regulates individuals offering occupational therapy services to the public in order to:
- Safeguard the public health, safety and welfare
- Protect the public from being misled by incompetent and unauthorized persons
- Assure the highest degree of professional conduct on the part of occupational therapists and occupational therapy assistants
- Assure the availability of occupational therapy services of high quality to persons in need of such services
The Board of Examiners for Occupational Therapy was created to carry out the provisions of the Occupational Therapy Act and consists of five members appointed by the Governor who have been residents of the state for two years preceding the appointment. Three members shall be licensed under the provisions of the Occupational Therapy act and have a minimum of five years’ professional experience, with two years’ experience in New Mexico, and have not had their licenses suspended or revoked by this or any other state. One of the professional members may be an occupational therapy assistant and one of the professional members may be a retired occupational therapist or occupational therapy assistant who has been retired for no more than five years at the time of appointment. Two members shall represent the public. The two public members shall have no direct interest in the profession of occupational therapy. Appointments are made for staggered terms of three years.
