Permitting Information

CID is responsible for review and approval of residential and commercial plans, and the issuance of building permits. The Division reviews plans to verify compliance with electrical, mechanical, and general construction code requirements adopted by the State of New Mexico. 

In addition to CID, there are approximately 28 local building departments throughout the state which handle some permitting and inspection responsibilities. There are also a number of city or county planning and zoning agencies which must provide approvals before you can submit a project for permit with the Construction Industries Division.

Variance Request Procedure

Planning and Zoning

You must obtain the appropriate signatures from the following planning and zoning departments BEFORE submitting plans for permit to the Construction Industries Division. CID provides this planning and zoning informatino as a courtesy, so be aware that it may be subject to change. Variance Request Procedures

Variance requests regarding approval of items not specifically addressed by the code or regarding deviation from code requirements must be submitted in writing. Send these requests to:

In your request, detail issues of concern and include a summary of the project’s planned scope of work along with a code analysis for reference. The request must state the specific variance to be considered. In addition, the request must include any other relevant documentation in support of the request, and note the CID staff member who initially addressed this concern.

Review Procedure for Variance Requests in Construction

The CID Review Committee (consisting of the Trade Bureau Chiefs for General Construction, Electrical and Mechanical Bureaus and the Plans and Permitting Manager) will review all proposed variance requests in construction. In the case of the proposed use of unrecognized alternative methods and materials in construction, the Review Committee may provide recommendations governing approval or denial of the request and may recommend a Technical Advisory Committee (TAC) review the proposal.

Following reviews by each member of the CID Review Committee, written comments are made and are followed by an APPROVAL or DISAPPROVAL. A letter, along with comments, and either an APPROVAL or DISAPPROVAL by each member of the Review Committee, is thenmailed to the individual requesting the variance.

Appeals

Appeals to the CID Review Committee's action must be submitted in writing to the CID Division Director. Additional information and/or justification may be presented. If the Director upholds the Review Committee action to disapprove, an appeal may be made to the Construction Industries Commission. Appeals to the Commission must be made in writing by the first Friday of the month. The request to be placed on the Commission agenda must include who will present the variance request. The Commission generally meets on the third Friday of the month. The Construction Industries Commission approves variances for specific projects and not for general use for all construction.
